The Legal Assistance Referral Scheme is available to assist witnesses in coronial inquests who require independent advice about invoking the privilege against self-incrimination and s61 of theCoroners Act 2009.
In all circumstances, the witness’ consent to referral must be obtained. The advice will usually be provided by phone or video conference in advance of the inquest, where possible. The location and time of the advice appointment will be arranged at the convenience of the witness, the barrister and the referring party.
In the spirit of facilitating the efficient administration of justice, barristers who assist coronial witnesses through this Scheme participate on a voluntary basis. As with all other LARS referrals, once a barrister has accepted a referral, LARS has no further involvement. If the witness needs further assistance beyond one hour, it will be open to the barrister and the witness to enter into a further agreement, including any fee agreement.
While every effort is made by the Bar Association, please be advised it is not always possible to find a barrister to assist.
